Elections at The Ukraine, October 28, 2012

Yesterday was Parliament Election in Ukraine. The first exit poll said that Region Party is leader - 30.40%, United Opposision "Bat'kivschyna" (Yatsenuk and others) - 23.87%, Udar Party (Vitali Klischko) - 14.67%, Communists - 12.7%, Svoboda - 11.92%.

Voters in Ukraine headed to the polls on Sunday. But with opposition leader Yulia Tymoshenko and other critics of President Viktor Yanukovych still in prison, observers warned that the vote could be undemocratic.

At first glance, everything looked to be working as it should in a democracy: There was an election campaign with more than 20 parties vying to lead the country, and the opposition was strong and confident of a victory.
The parliamentary election in Ukraine on Sunday (28.10.2012) would be "transparent and democratic," President Victor Yanukovych said. Following an example from Russia, Ukraine had webcams installed in all polling stations for maximal transparency.
But that first glance was misleading. Observers from the Organization for Security and Co-operation in Europe (OSCE) could for the first time since 2004 call an election in Ukraine undemocratic and unfair. The organization sent 635 election observers to the country - more than ever before. In total, some 3,800 foreign observers were monitoring the vote.
The interest is especially big because many deem the country to be on the path to an autocratic system since Yanukovych won the presidency in 2010. At least that's the way the opposition sees it. Experts and the European Union are concerned about the development in a country that was once seen as a beacon of democracy in the post-Soviet era.

'The most prominent example is the leader of the opposition and former prime minister, Yulia Tymoshenko. For the first time since 1998 she was not able to take part in the election. The 51-year-old, who played a leading role in the 2004 Orange Revolution, has been in prison on a conviction for abuse of office for over a year.
A court in Kyiv sentenced her to seven years behind bars for signing gas deals with Russia when she was still prime minister. The trial drew widespread international condemnation. Other opposition figures, like Tymoshenko's former Interior Minister Yurij Lutsenko, are also in jail and were excluded from the vote.
The European Parliament issued a resolution describing the incarceration of opposition members as an attempt to eliminate political opponents from the democratic process. Some European parliamentarians expressed their doubts about the election.
"If the opposition can't run with their leading figures, then this is not a free election," said Elmar Brok, a German conservative MEP, before the vote. Wolfgang Thierse, the deputy head of Germany's Social Democrats, agreed. "In as far as political opponents are excluded from this election, the fairness of the poll is in doubt," Thierse told DW last week.

Tymoshenko's absence from the political scene was clearly felt, said well-known Kyiv columnist Serhij Rachmanin. The election campaign had been unspectacular without any strong personalities, heated debates and new topics, he said. Many of the voters, he added, had been simply resigned.
According to opinion polls, there were four parties likely to surpass the 4 percent threshold required to make it into parliament. The strongest party seemed to be the incumbent Party of the Regions with about 23 percent. The United Opposition, a coalition founded on Tymoshenko's Fatherland party, stood at around 17 percent before the vote. That's almost exactly as much as the UDAR party of boxing world champion Vitali Klitschko. In some polls, Klitschko's party even came in second.
The party is new and its popularity is still on the rise. After the vote, Klitschko has said he wants to join forces with Tymoshenko's party, but he refused to sign a coalition deal ahead of the vote. The fourth strongest party will most likely be the Communists, who were expected to win around 10 percent of the vote.

The outcome of the election, however, remained difficult to predict as 38 percent of voters had not yet decided whom they would support, according to a DW poll last week.
It could be that for the first time, extreme right-wing party Swoboda ("Freedom") will make it into parliament. Tymoshenko's party has already signed a coalition deal with Swoboda. Some experts, including Wilfried Jilge of Leipzig University, see this as a dangerous move.
Jilge described Swoboda as anti-European, anti-liberal and a party with neo-Nazi tendencies. The governing Party of the Regions used Swoboda in their election campaign do discredit the entire opposition, Jilge said. The pro-Western opposition would, according to Jilge, have been better advised to stay clear of the likes of Swoboda.

Ukraine’s Troubling Trends



IT has been 21 years since Ukraine gained its independence from the Soviet Union. Since then, Ukrainians have made much progress on reforming and modernizing their country. Ukraine has also become an important partner on a number of pressing global and regional issues, from nuclear nonproliferation to food security and the settlement of protracted conflicts.
Ukraine now stands at an important juncture. Many of its neighbors in Central and Eastern Europe have shown the world what can be accomplished in terms of democratization and economic prosperity. Ukraine has the capacity to do the same. Important steps now have to be taken by the Ukrainian government to fulfill its full potential.
This is especially true when it comes to strengthening democratic institutions to ensure the respect of fundamental freedoms. Ukraine’s parliamentary elections at the end of this month will be an important bellwether for the state of these institutions. At the moment, there are some worrying trends, as confirmed by the latest interim report by the election observation mission of the O.S.C.E.’s Office for Democratic Institutions and Human Rights.
We are concerned about reports of the use of administrative resources to favor ruling party candidates and the difficulties several media outlets face. Similarly, we are concerned about the continuation of the practice of the Central Election Commission holding closed pre-session meetings and the lack of representation of some political parties on district and precinct election commissions. Distribution of material or financial benefits to voters is another issue that should be investigated and halted.
We regret that the convictions of opposition leaders during trials that did not meet international standards are preventing them from standing in parliamentary elections. The Ukrainian government needs to address these selective prosecutions, including the case of former Prime Minister Yulia V. Tymoshenko and other former senior officials.
The United States and the European Union are doing their part for a free and fair election, supporting election observers and helping to train election officials, encourage voter education and protect the rights of candidates and voters.
But these are not the European Union’s elections or America’s elections. They are Ukraine’s. This is a moment when Ukraine’s leaders should deliver for their citizens. They expect President Viktor F. Yanukovich and his government to address these concerns, especially to ensure that the right to political participation is upheld and to provide for fair media access for all candidates.
We know this is possible because Ukrainians have done it before. Just over two years ago, they elected a new president in what many observers consider the country’s freest and fairest national election. With that contest, Ukrainians set their own high standard, a standard that should be met in this month’s election.
We are also mindful of Ukraine’s broader reform agenda. While some progress has been made, we hope the elections will lead to a vigorous and effective effort by the country’s leaders to advance important core reforms, including the investment climate and the energy sector. Much is at stake here for Ukraine’s future.
The European Union and Ukraine have completed negotiations on an ambitious Association Agreement that will provide for the country’s political association and economic integration with the European Union, including by establishing a Deep and Comprehensive Free Trade Area. It would offer Ukrainian businesses greater access to 500 million consumers in the European Union and advance Ukraine on the path toward a modern European democracy.
But the European Union will only be able to move forward with such an ambitious agenda if the democratic rights of the Ukrainian people, including freedoms of expression, political participation, association and media, are respected, the rule of law is put on strong footing, and progress is made on the overall reform agenda.
It remains deeply in our common interest to see an independent, prosperous and irreversibly democratic Ukraine that is associated with the European Union. We want to pursue deeper, mutually beneficial partnerships with Ukraine and will continue working toward a day where Ukraine will fully realize its own potential and take its place among the modern democracies of Europe.

Most East European states are a long way from democratic; but the stability of their regimes depends on respecting certain rules of the game, such as dividing the spoils. It is normally the President who acts as ‘Lord of The Rings’ to keep the various circles of interest in balance - though there are several ways of playing the role. The president may be above the game, or he may control the key forces of balance in the game, like kompromat or ‘judicial resources’. He may be a player himself (less likely herself), which would give him weight; but if he and his supporters win control of too many resources they will not be trusted by the other players. More than twenty years after the fall of the USSR, ‘transition’ may be a forlorn hope, but time can undermine balance: several East European regimes are now showing destabilising signs of incumbents’ greed.
It is Ukraine under Yanukovych where elite politics seems to be going most badly awry. Nostalgic supporters of former President Kuchma (1994-2005) recall that he played the game with more skill: oligarchs were kept inside the tent and the tent itself (i.e. the institutions of state) was less flimsy. As with the famous lament of moderate Germans in the 1930s (“First they came for the communists, but I didn’t speak out because I wasn’t a communist...”), Yanukovych has gradually upped the ante. He spent his initial months in office rewarding his campaign supporters. Then former ’orange’ oligarchs were pressurised to join his camp. Then the big fish started to eat the smaller fish, using the tax and regulatory authorities to soften up their targets first. ‘Raiderstvo’ has escalated out of hand. Ukraine’s SME sector is actually shrinking, to less than 20% of GDP.
Then the system turned cannibalistic. Yanukovych has proclaimed ‘equidistance’ from the oligarchs, but to take over rather than take down their empires. No one is now safe from the rise of the literal and metaphorical Yanukovych ‘Family’, a phenomenon which Yuliia Mostova, the editor of the Ukrainian paper ‘Mirror of the Week’, has dubbed ‘Semostiinyi Yanukovych’ (a play on words, meaning ‘independence in the family’); also arguing that ‘Yanukovych is the first president of Ukraine who needs a controlling packet not only of all power in the country, but of all its business too’. The ‘Family’ is now crossing swords with other previously untouchable oligarchs, moving into coal and expanding in telecoms and agriculture.
Yanukovych is gambling that he has made the presidency stronger than in Kuchma’s time, but we can guess how the process will end, with a friendless Yanukovych suddenly stabbed in the back. However, there is no telling when this might be or how much damage will have been done by then. In the meantime, moreover, the game of balance doesn’t disappear; it just gets displaced. The upcoming elections on 28 October are about more than government versus opposition. They are also about Yanukovych’s plans to win an all-powerful two-thirds’ majority in parliament, and about the threatened oligarchs spreading their bets within that majority, ‘independents’ and opposition.
Elsewhere in the region, the rise and rise of the Pashayev family in Azerbaijan, the relatives of First Lady Mehriban Aliyeva, threatens the interests of older groups such as Minister for Emergency Situations Kamalledin Heydarov, and the head of the Presidential Administration Ramiz Mehdiyev. After a dynastic succession in 2003 President Ilham Aliyev may now want to become his own man, gradually distancing himself from the old guard who served his father before him; but Aliyev’s natural caution is probably wiser than Yanukovych’s haste, as the likes of Heydarov run what are practically independent fiefdoms (‘Emergency Situations’ gives him vast licensing power over construction and other business, and he still controls the customs).
In Armenia, the oligarchy is now split, with the Prosperous Armenia party controlled by leading oligarch Garik Tsarukyan moving into opposition after the May 2012 parliamentary elections, in advance of the presidential contest due in February 2013. Armenia has always had both a strong opposition and a strong state, with the strength of the latter a function of post-war ‘securitisation’ and elite unity. Both may be declining assets – despite Azerbaijan’s ongoing military build-up.
Belarusian President Aliaksandr Lukashenka has many faults, but he has skilfully avoided having to play the game of balance. Belarus has plenty of rich Lukashenka supporters, but no independent oligarchs – not even the businessmen on the EU sanctions list like Yury Chyzh or Uladzimir Peftsiew.
Lukashenka has also long resisted the formation of a regime party that would act as a lobby for collective elite interests. But he needs extra props for his regime after the severe economic crisis of 2011. It is therefore potentially significant that 63 out of the 109 new MPs elected in September 2012 have been claimed as supporters of ‘Belaya Rus’, the would-be Belarusian equivalent of United Russia, first set up in 2007 (which is not the same as enthusiastic members); which may become a fully-fledged political party at its congress due in November 2012. Its patron is Aliaksandr Radzkow, Deputy Head of the Presidential Administration, who has floated the name of ‘Belarusian Party of National Unity’.
And what about Russia? The rules of balance were completely rewritten by the Yukos affair, but both before and after Khodorkovsky’s arrest the point of reference was clear - before 2003 it was the succession agreement with the Yeltsin ‘Family’, after 2003 it was Putin himself. The point of ‘Operation Successor 2.0’ in 2008 was that Putin would remain powerful enough to continue playing the role of arbiter between the clans. This was managed successfully enough through the election, but the ‘tandem’ introduced enough uncertainty for the ‘Friends of Putin’ to gain a destabilising margin of extra influence under the Medvedev Presidency; and it is not yet clear how Putin’s third term will redress the imbalance, if indeed he still wants to try. Economic factors are also key: a new round of privatisations, particularly tranches of energy companies like Rosneft, Transneft, Transnefteprodukt and Zarubezhneft, at a time of continued elite division, opposition protest and weakening global energy markets, could make the mixture even more combustible.
